Litigation is the process of taking a case through court, and one of the ways people and companies resolve disputes arising out of an infinite variety of factual circumstances. It is most common in civil lawsuits, in which a plaintiff brings a charge against a defendant. When a lawsuit is not settled outside of court by an agreement between the parties it will eventually be heard and decided by a judge or jury in a court.

Arbitration and Mediation are alternative dispute resolutions to litigation. In arbitration, a private arbitrator hears both sides of the case and makes a decision. In mediation, a type of structured meeting with the parties is held with an independent third party who works to help them fashion an agreement among themselves.
